"John of the Forest"
The Will of Capt. John ("John of the Forest") MARSHALL, signed 1 April 17
52 and proved 26 May 1752:
Being very sick and weak, but of perfect mind and memory, I first give a
nd recommend my soul to God that gave it, and my body to be buried in Chri
stianlike and decent manner, at the discretion of my executor, hereinaft
er mentioned:
I. Item: I give and bequeath unto my beloved daughter, Sarah LOVELL, one n
egro girl, named Rachel, now in possession of Robert LOVELL.
II. Item: I give and bequeath unto my beloved daughter, Ann SMITH, one neg
ro boy named Daniel, now in possession of Augustine SMITH.
III. Item: I give and bequeath unto my beloved daughter, Lizzie SMITH, o
ne negro boy named Will, now in possession of John SMITH.
IV. Item: I give and bequeath unto my beloved wife, Elizabeth MARSHALL, o
ne negro fellow, named Joe, and one negro woman named -, and one negro wom
an -, after delivering the next child born of her body, to my son John; un
til which time she shall remain in the possession of my wife, Likewise I l
eave my corn and meat to remain for the use of mare named "Beauty,' a
nd a side-saddle; also six hogs; also I leave her the use of my land duri
ng the widowhood, and afterward to fall to my son, Thomas MARSHALL, and h
is heirs forever.
V. Item: I leave my tobacco to pay my debts, and, if any be over, for t
he clothing of my small children.
VI. Item: I give and bequeath unto my well-beloved son. Thomas MARSHALL, o
ne negro woman named Hannah, and one negro child named Jacob.
VII. Item: I give and bequeath unto my well-beloved son John MARSHALL, o
ne negro fellow named George, and one negro child named Nan.
VIII. Item: I give and bequeath unto my well-beloved son, William MARSHAL
L, one negro woman named Sall, and one negro boy named Hannibal, to rema
in into the possession of his mother until he becomes of the age of twen
ty years.
IX. Item: I give and bequeath unto my beloved son, Abraham MARSHALL, one n
egro man named Jim, and one negro girl named Bett, to remain in the posses
sion of his mother until he comes to the age of twenty years.
X. Item: I give and bequeath unto my beloved daughter, Mary MARSHALL, o
ne negro girl named Kate, and one negro boy, Gus, to remain in possessi
on of her mother until she comes to the age of eighteen years, or until ma
rriage.
XI. Item: I give and bequeath unto my beloved daughter, Peggy MARSHALL, o
ne negro boy named Joshua, and one negro girl named Liz, to remain in poss
ession of her mother until she comes to the age of eighteen, or until marr
iage.
XII. Item: I leave my personal estate, except the legacies above mentione
d, to be equally divided between my wife and six children above mentione
d. [Perhaps his six unmarried children.]
XIII. Item: I constitute my wife and two sons, Thomas MARSHALL and John MA
RSHALL, executors of this, my last will and testament.
